ONU: Preparan proyecto de resolución contra el espionaje de Estados Unidos
Según el borrador actualmente en estudio (Ver el documento en inglés al final de esta información), los Estados miembros de la ONU quedarían obligados a adoptar las medidas necesarias para garantizar la protección de la vida privada de los ciudadanos. También según ese documento, el secretario general de la ONU se vería por su parte obligado a presentar informes periódicos sobre la aplicación de esas medidas.
El documento resalta además que ese tipo de espionaje es totalmente incompatible con la noción misma de democracia.

UN condemns East Timor militia leader’s “release”
"If the reports are true, his release is contrary to the Security Council resolutions which set up the UN Mission in (East Timor) and seriously undermines the global principle of accountability for crimes against humanity," Secretary General Ban Ki-moon's spokeswoman Marie Okabe said in a statement.
The UN said earlier this week that the suspect, Martenus Bere, had been released Sunday ahead of national celebrations commemorating 10 years since East Timor won independence from Indonesia in a UN-backed referendum.
The government has refused to confirm Bere's release amd the UN appeared to backtrack on Tuesday, saying in a separate statement that its mission in Dili was "not in a position to comment" on Bere's circumstances.
Bere was detained in East Timor on August 8, five years after being indicted for his role in the 1999 Suai Church massacre, in which up to 200 people were killed.
"The UN's firm position is that there can be no amnesty or impunity for serious crimes such as war crimes, crimes against humanity and genocide," Okabe said.
"In that context, the Office of the High Commissioner for Human Rights strongly opposes the release of someone for whom an arrest warrant of this nature has been established."
East Timor's leadership has been criticised for opposing prosecution for those responsible for abuses during Indonesia's bloody 1975-1999 occupation of the half-island, which killed around 100,000 people.
President Jose Ramos-Horta says restoring good relations with Indonesia is more important than "prosecutorial justice", and has said he will not let his country be used as an "experiment" in international justice.
The opposition Fretilin party however says he is out of touch with the East Timorese people, many of whom continue to demand justice for gross human rights abuses committed during the Indonesian occupation.

Indonesia's Special Forces (Kopassus), more than any other in the Indonesian military, stands accused by the Indonesian people of some of the most egregious human rights violations.
The history of Kopassus human rights violations, its criminality and its unaccountability before Indonesian courts extends back decades and includes human rights and other crimes in East Timor, Aceh, West Papua and elsewhere. The crimes of Kopassus are not only in the past. A recently published Human Rights Watch report details ongoing Kopassus human right violations in West Papua.
In 2008, the Bush administration proposed to restart U.S. training of Kopassus. the State Department legal counsel reportedly ruled that the ban on training of military units with a history of involvement in human rights violations, known as the Leahy law, applies to Kopassus as a whole.

Timor-Leste/GUTERRES NAMED ACTING PRIME MINISTER DESPITE CORRUPTION INVESTIGATION

The appointment of Jose Luis Guterres as Acting Prime Minister of Timor–Leste despite unresolved allegations of serious corruption, again shows that the governing AMP coalition considers itself above the law, FRETILIN’s deputy parliamentary leader, Francisco Branco MP,
said today.
Guterres was named Acting PM after de facto Prime Minister Gusmao was urgently evacuated to Singapore for medical treatment.
Branco said evidence emerged 18 months ago, in January 2008, of abuse of power by Guterres while he was Foreign Minister.
He said Guterres unilaterally granted his wife Ana Maria, then a junior staff member at Timor-Leste’s diplomatic mission to the United Nations in New York, the salary of a diplomat far exceeding her entitlements.
“As a foreigner and non-citizen Ana Maria Guterres could not legally be classified as a diplomat, yet her husband gave her a salary exceeding even that of the Head of Mission,” Branco said.
FRETILIN called for Guterres to be investigated in February 2008, but MPs from the AMP demanded proof, and so on April 8, 2008, FRETILIN presented an email written by Mr Guterres' wife Ana Maria in June 2007, which read in part:
"The transfers made into my personal account by the Ministry of Finance to date were respectively $10,673.33 on 24 November (being for the first quarter) 2006, $8,005.00 on 11 January (being for the second quarter) and $18,667.14 on 11 April (being for the third quarter)
which can certainly be verified with the Ministry of Finance. I only became aware at the time I sought verification that by law, even though I possess a Timorese Diplomatic passport, I do not have citizenship rights because I have not lived in Timor-Leste for a minimum of eight years. For this reason I could not be classified as a Diplomat for contractual purposes nor for entitlements."
On ABC Radio Australia Connect Asia program on February 6, 2008, Mr Guterres admitted that he had in fact authorised these payments to his wife, saying: “it was a temporary solution, it was not a solution that I wanted to. But at that time in the situation of crisis in East Timor, and I had to come back to East Timor to serve the country, therefore the available solution at that time.”
Francisco Branco said: “Jose Luis Guterres had a clear conflict of interest given he was the Minister for Foreign Affairs and effectively his wife’s boss. He abused his power to benefit his own family with something to which it was not legally entitled. That is official corruption in anyone’s book.
“Now he is in charge of the nation whilst the de facto Prime Minister is away receiving urgent medical treatment. Many in Timor-Leste are wondering what Guterres is up to right now, given his track record.”
Branco said FRETILIN MPs asked the Ombudsman for Human Rights and Justice (the Provedor) to investigate the allegations against Guterres more than a year ago, but had heard nothing about the investigation.
“During the fortnight before he was evacuated to Singapore, the de facto Prime Minister himself was the subject of very serious allegations that he breached the Procurement Law and State Office Holders Law in awarding contracts without tenders to his daughter and relatives of other government ministers.
“Xanana Gusmao is full of fine rhetoric about how he is leading the fight against corruption, nepotism and collusion.
“Yet we know that the Provedor has had a hard time trying unsuccessfully to get Ministers and the Prime Minister to cooperate in delivering documents or responding to requests for information
concerning allegations of corruption by his ministers.”

We urge you not to appoint Adm. Dennis Blair as Director of National Intelligence. During his years as Pacific Commander, Blair actively worked to reinstate military assistance and deepen ties to Indonesia's military, despite its ongoing human rights violations in East Timor and its consistent record of impunity. In 1999, he undermined the U.S. efforts to support human rights and self-determination in the Indonesian-occupied territory and opposed congressional efforts to limit assistance.
In April 1999, just days after Indonesian security forces and their militias carried out a brutal, churchyard massacre, Adm. Blair delivered a message of 'business-as-usual' to Indonesian General Wiranto, then Commander of the Indonesian armed forces. Following East Timor's pro-independence vote, Blair sought the quickest possible restoration of military assistance, despite Indonesia's highly destructive exit and the failure, which continues to this day, to prosecute the senior officials who oversaw the violence.
This lack of concern for human rights shows that he is unlikely to be a champion of reform. I don't believe that this is the kind of change people are expecting.

On September 28, 2008, Timor Leste's de facto Prime Minister, Xanana Gusmao, declared in Ainaro that a proposed 'March of Peace' sponsored by the largest party in the parliament, FRETILIN, would be crushed when it arrived in Dili. FRETILIN's leadership denounced this threat as illegal and dictatorial, in a media conference in Dili yesterday.
The Prime Minister's threat was also broadcast nationwide on radio and television. His exact words were: "I hear that you from here are preparing a March of Peace to Dili. I will wait for you there, and put you all in jail!"
FRETILIN President Francisco (Lu Olo) Guterres said, "I and many who heard those threatening words simply wish to ask why Mr Gusmao feels the need to threaten people who wish to demonstrate their political conviction and express their constitutional rights to undertake a march with totally peaceful intentions, to show peace, with a spirit of democracy.
Why are they the subject of threats from our nation's leaders to 'put you in jail'?"
"I remind Mr Gusmao that according to our Constitution, in a state under the rule of law, it's not he who 'puts people in jail'", said Mr Guterres. "In a democratic state under the rule of law, only a court of law can 'put people in jail' and then only if it is proven in a court that they have breached the law. But it is certainly not the Prime Minister, or even the President or a Liurai (traditional feudal King) who can just do so because that is his wish. Not even the Army or the Police or the UN Police can jail anyone without a court order or warrant, and then only if the law is being broken.
"Only in a dictatorship like the old Portuguese Colonial dictatorship and the Suharto regime can a Prime Minister simply jail people without a trial as he wishes. But not in a sovereign, constitutional and democratic Timor-Leste," declared Guterres.
Clause 42 of the Constitution of the RDTL gives everyone the freedom and right to demonstrate within the law. Timor-Leste has ratified the UN Charter and Conventions that also guarantee these rights and freedoms.
According to Guterres, the people persistently demand the Peace March to affirm Peace and Democracy and Justice in the country. "It is a March that, when it happens, will be peaceful, in a spirit of democracy, respecting the rights of other citizens and the law and all State institutions," he said.
"The planned Peace March by FRETILIN, its allies and communities, will be done to take this country in a better direction, not as our history shows, especially in 2006, to mobilize people to take this country in a worse direction.
"We ask all relevant State institutions to assure that those participating in a lawful Peace March will be able to so exercise their rights and freedoms without threats of incarceration, and especially call on the police to protect them as they do so," Guterres insisted.
"We ask the State, especially the government, not to politicise the police against the people who wish to march in the planned March of Peace, because we also heard last Saturday the de facto Prime Minister in Ainaro say that 'I have told the police that I will not permit any small group to lie to the people'. FRETILIN is not a small group of people, but whether the group is large or small, we all have a right to lawfully carry on our political activities," said Guterres.
He argued that the people feel the need to reaffirm a democratic state under the rule of law because in just one year the country had fallen more and more towards a dictatorship, with increasing breaches of human rights.
Guterres noted the arrest and beating of journalists, and the arrest without warrant of Opposition MPs, during the state of siege following the shootings on February 11 this year, and the recent repression of student protests about the state budget and the purchase of luxury 4WD Prados for MPs. So far there has been no substantive response to the reports on these violations by the Ombudsman for Human Rights and Justice.
"So these are not just threats from our recent experience," noted Guterres.
Guterres urged national leaders not to threaten the people with jail, and not to use words like 'cannons', 'armored tanks', or 'battalions', which the Prime Minister used in his Ainaro speech. "It is better if you all start to speak of the constitution, peace, democracy, tolerance, freedom, justice, the rule of law and the rights our people have to live in peace and express their political views free from fear or threats," Guterres said.
Guterres also asked people not to be affected by the threats against their rights. "When all of us walk this lawful path of peace and democracy, there will be no jail big enough to incarcerate us all," he concluded defiantly.

A FRETILIN "não muda uma vírgula" no plano de realizar a Marcha da Paz em Díli nos próximos meses, segundo afirmou, ontem, o presidente do maior partido da oposição, Francisco Guterres "Lu Olo".
O líder da FRETILIN respondeu, em conferência de imprensa, a declarações do primeiro-ministro, Xanana Gusmão, num discurso em Ainaro, a 28 de Setembro.
"Lu Olo" acusou Xanana de ter dito à população que "tinha ouvido que se preparava a Marcha da Paz" para Díli, mas que "não valia a pena" as pessoas descerem à capital.
"O primeiro-ministro disse que estaria à espera de quem se manifestasse e que os meteria a todos na cadeia", acusou o líder da FRETILIN. (Agência Lusa)
